CDM Creative LLC Terms & Conditions
Effective Date: January 1, 2026
Last Updated: October 22, 2026
Company: CDM Creative LLC
Website: www.learn.candicedmadrid.com
Contact Email: info@cdm-creative.com
1. Introduction and Scope
These Terms & Conditions (“Terms”) govern access to and use of the websites operated by CDM Creative LLC (“Company,” “we,” “our,” or “us”), along with our courses, consulting services, workshops, memberships, downloadable resources, templates, and other digital products and services (collectively, “Offerings”).
These Terms apply to Offerings purchased directly from us or through authorized checkout pages, course platforms, and other sales channels identified as operated by CDM Creative LLC.
“You” and “your” refer to the person purchasing or using an Offering. If you purchase on behalf of a business or organization, you represent that you have authority to bind that entity.
We present these Terms for your review before purchase. By affirmatively accepting them at checkout or when entering into a service agreement, you agree to be bound by them.
If you do not agree, do not purchase or enroll in our Offerings.
2. Eligibility and Account Responsibilities
You must be at least 18 years old and legally capable of entering into a binding agreement to purchase our Offerings.
You agree to:
Provide accurate billing, contact, and account information.
Keep your email address and payment information current.
Maintain the confidentiality of your login credentials.
Use our Offerings only for lawful purposes.
Notify us promptly if you suspect unauthorized access to your account.
Unless a purchase expressly includes multiple users or a team license, access is limited to the individual purchaser. Sharing login credentials or allowing others to use your account is prohibited.
3. Product Descriptions and Order-Specific Terms
The applicable sales page, checkout page, order confirmation, or signed service agreement identifies what your purchase includes.
Depending on the Offering, this may include:
Course lessons and educational materials.
Downloadable files or editable templates.
Live sessions or recorded workshops.
Consulting appointments.
Community access.
Feedback, support, or implementation services.
A specified access period or project timeline.
Do not assume that an Offering includes individual consulting, unlimited support, custom work, future products, certification, or services not expressly listed.
A signed service agreement controls over conflicting provisions in these Terms. Clearly disclosed terms specific to an Offering control over these general Terms for that Offering.
4. Digital Delivery and Course Access
4.1 Delivery
Digital products are delivered through the method stated at purchase, which may include email, a download link, or access to an online platform.
You are responsible for providing a correct email address and checking spam or promotional folders for delivery instructions.
If you do not receive access, contact us at info@cdm-creative.com so we can investigate.
4.2 Access Duration
Your access period will be stated on the applicable sales or checkout page.
Unless expressly stated otherwise, a purchase does not include lifetime access, ongoing consulting, permanent community membership, or access to future products.
If an Offering is expressly sold with “lifetime access,” that means access for the period during which CDM Creative LLC operates and supports that particular Offering—not the purchaser’s lifetime or a guarantee of perpetual hosting.
We will not use the discontinuation or renaming of an Offering to evade a specific access commitment made at purchase.
4.3 Updates and New Products
Updates are included only where stated in the Offering description.
A purchase does not automatically include separately sold courses, advanced programs, new editions, memberships, or other future Offerings.
4.4 Platform Changes or Discontinuation
We may change hosting platforms or delivery methods. If a change affects an active access commitment, we will make reasonable efforts to preserve access and provide instructions for any necessary transition.
If we permanently discontinue an Offering before its promised access period ends, we will provide an appropriate alternative, refund, or other remedy consistent with the purchase terms and applicable law.
Where practicable, we will provide advance notice of material access changes.
5. Intellectual Property and Permitted Use
5.1 Ownership
Our courses, videos, recordings, written materials, graphics, worksheets, templates, website content, and other materials are owned by CDM Creative LLC or its licensors.
Purchasing an Offering does not transfer ownership of its underlying intellectual property.
5.2 Limited License
Subject to payment and compliance with these Terms, you receive a limited, non-exclusive, non-transferable license to use purchased materials for your personal learning or internal business purposes.
You may apply the ideas and skills you learn to your own business. However, you may not redistribute the instructional materials themselves.
5.3 Templates and Client Work
If a template or resource is advertised for commercial or client use, its product-specific license determines how it may be used.
Unless that license expressly allows it, you may not:
Resell or redistribute the original template or source file.
Offer the material as a standalone product.
Include it in a template library, membership, or competing course.
Give clients access to reusable source materials.
Customizing a template does not automatically give you the right to resell the underlying template.
5.4 Prohibited Uses
Except as expressly authorized in writing or permitted by applicable law, you may not:
Share purchased materials or account access with others.
Copy, publish, upload, distribute, sublicense, or resell our materials.
Repackage our materials as your own course, training, or product.
Remove copyright notices or other ownership identifiers.
Record or redistribute private sessions or course content without permission.
Bypass access controls or security measures.
5.5 Artificial Intelligence and Likeness
Without our written permission, you may not upload nonpublic purchased materials into an AI system for model training, public redistribution, or creation of a substitute or competing product.
You may not use our recordings, photographs, voice, or likeness to create impersonations, voice clones, deepfakes, or misleading synthetic content.
This restriction does not prevent you from using general skills learned through our Offerings or using AI tools with materials you independently own.
6. Consulting and Custom Services
6.1 Scope of Services
Consulting and custom services are limited to the scope described in your purchase confirmation, proposal, or signed agreement.
Additional meetings, revisions, implementation, deliverables, or support may require a separate agreement and additional fees.
6.2 Client Responsibilities
You agree to provide requested materials, feedback, approvals, and access reasonably necessary for us to perform the agreed services.
Delays in providing these items may affect scheduling and completion dates. We will communicate material timeline changes when reasonably possible.
You are responsible for ensuring that materials you provide can lawfully be used for the project.
6.3 Scheduling, Rescheduling, and Missed Sessions
Unless different terms are disclosed before purchase:
Requests to reschedule must be received at least 24 hours before the scheduled session.
A session missed or canceled with less than 24 hours’ notice may be treated as used and nonrefundable, except where applicable law requires otherwise.
Late arrival does not automatically extend the scheduled session.
If we cancel a session, you may reschedule or receive a refund for that undelivered session.
Any deadline for using a consulting package must be disclosed before purchase.
6.4 Custom Deliverables
Ownership and usage rights for custom branding, website, publishing, marketing, or other creative deliverables will be addressed in the applicable service agreement.
Purchasing consulting does not automatically transfer ownership of our pre-existing processes, frameworks, templates, or tools.
6.5 Confidentiality and Recording
We will use reasonable care to protect nonpublic business information you share during private consulting and use it only to provide services, administer our business, or meet legal obligations.
This does not cover information that is public, independently developed, lawfully obtained elsewhere, or required to be disclosed by law.
Group sessions and communities are not confidential environments. Do not share sensitive information you do not want other participants to receive.
We will disclose any planned session recording in advance and obtain consent where required. Private consulting recordings will not be used in public marketing without separate permission.
7. Pricing, Payments, and Taxes
7.1 Prices
Prices and currency are displayed before purchase. Unless otherwise stated, prices are in U.S. dollars.
We may change prices for future purchases. Price changes do not alter an existing agreed purchase price or installment schedule.
Applicable taxes will be collected where required.
7.2 Payment Processing
Payments may be handled by third-party payment providers. Your use of a payment service may be subject to that provider’s applicable customer terms.
You authorize the charges specifically disclosed and accepted at checkout.
7.3 Installment Plans
An installment plan divides the purchase price of an Offering into scheduled payments. It is not a cancel-anytime subscription unless expressly described that way.
Before purchase, we will disclose the total price, number of payments, installment amounts, and payment schedule.
Unless a refund, cancellation right, or other exception applies under your purchase terms or applicable law, stopping use of the Offering does not cancel the remaining installments.
7.4 Failed Payments
If a scheduled payment fails, we may notify you, retry the payment as authorized, and temporarily suspend access until the account is brought current.
Any additional fee must be disclosed and agreed to before it is charged and must be permitted by applicable law.
7.5 Billing Errors and Payment Disputes
If you believe a charge is incorrect or unauthorized, please contact info@cdm-creative.com so we can investigate.
Nothing in these Terms limits any rights you may have to dispute a charge with your bank, card issuer, payment provider, or other authority.
8. Subscriptions and Memberships
This section applies only to Offerings expressly sold as recurring subscriptions or memberships.
Before enrollment, we will disclose the recurring price, billing frequency, renewal terms, and cancellation method.
Recurring charges require your affirmative authorization.
You may cancel through the method identified at enrollment or contact info@cdm-creative.com for assistance.
Unless otherwise disclosed or required by law:
Cancellation stops future renewals.
Access continues through the end of the paid billing period.
Partial billing periods are not refunded.
Canceling a subscription does not cancel a separate installment purchase.
We will communicate changes to recurring pricing before they take effect and obtain additional consent where required.
9. Refunds and Cancellations
9.1 Digital Products and Courses
Unless a different refund policy or guarantee is expressly stated before purchase, all sales of digital products and courses are final once access or downloadable materials have been provided.
We do not offer refunds for:
A change of mind.
Failure to use or complete the materials.
Purchasing without reviewing the stated description or requirements.
Lack of desired results.
Purchasing an Offering you already own, or one included in another Offering you purchased.
Scheduling conflicts affecting participation in an otherwise available Offering.
This policy does not exclude remedies for non delivery, materially misdescribed products, unresolved defects, billing errors, or rights provided by applicable law.
9.2 Access Problems and Duplicate Charges
Contact us promptly at info@cdm-creative.com if you experience non delivery, an access problem, or an incorrect charge.
Duplicate purchases. You are responsible for confirming whether you already own an Offering before purchasing. Each purchase of an Offering, including an Offering you already own or one included in another Offering you purchased, is a separate and final sale once access is provided. We do not offer refunds for purchasing an Offering more than once.
Billing errors. If a technical error results in you being charged more than once for the same transaction, or charged an amount other than the price shown at checkout, we will investigate and refund the incorrect charge.
Non delivery. If we cannot deliver what you purchased, we will provide a refund or another remedy you agree to.
9.3 Consulting and Custom Services
Refund and cancellation terms for consulting packages and custom projects will be stated in the applicable purchase terms or service agreement.
Unless otherwise agreed, fees for services already performed are nonrefundable, subject to applicable law.
If we cannot provide contracted services, we will address undelivered services through rescheduling, an agreed alternative, or an appropriate refund.
9.4 Consumer Rights
Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded.
If your jurisdiction provides a mandatory cancellation period or requires specific consent before immediate digital delivery, those requirements apply.
10. Educational Purpose and Results Disclaimer
Our courses, resources, and educational content provide general information and practical guidance. Consulting provides advice within the scope of the purchased service.
Unless expressly agreed through an appropriately qualified professional, our Offerings do not provide legal, tax, accounting, medical, mental-health, or investment advice.
You are responsible for determining whether a strategy is appropriate for your situation and obtaining professional advice when needed.
We do not guarantee any particular:
Income, revenue, or profit.
Audience growth or engagement.
Search ranking or website traffic.
Book sales or publishing outcome.
Client acquisition or business success.
Return on investment.
Results depend on factors including your experience, implementation, resources, market conditions, and circumstances beyond our control.
Testimonials and case studies describe individual experiences, not promises of your results. Any material relationship connected to an endorsement will be disclosed where required.
These disclaimers do not excuse misleading statements or failure to deliver expressly promised services.
Pricing tools and calculators provide suggested ranges for educational purposes only. You are solely responsible for the prices and quotes you set and send to your clients.
11. Third-Party Tools and Resources
Our Offerings may reference or link to third-party platforms, software, vendors, or resources.
Unless expressly included in your purchase, you are responsible for obtaining and paying for any required third-party tools.
Third-party providers control their own features, pricing, availability, terms, and privacy practices. We do not guarantee that they will remain unchanged.
Where we receive affiliate compensation for a recommendation, we will disclose that relationship where required.
12. Technology and Accessibility
You are responsible for having suitable internet access, a compatible device, and any software identified in the Offering description.
We do not guarantee uninterrupted access or compatibility with every device. Temporary outages may occur because of maintenance, technical issues, or third-party service interruptions.
If an interruption materially prevents us from delivering a purchased Offering, we will work toward an appropriate resolution consistent with our commitments and applicable law.
If you need an accommodation to access an Offering, contact info@cdm-creative.com. We will discuss available options and address requests consistent with applicable obligations.
13. Community Participation and Submitted Content
Where an Offering includes a community, discussion area, or group session, you agree not to:
Harass, threaten, discriminate against, or abuse others.
Post unlawful or infringing content.
Share another person’s private information without permission.
Spam, impersonate others, or engage in unauthorized solicitation.
Share purchased course materials or access credentials.
We may remove content or restrict participation for violations of these rules.
You retain ownership of content you submit. You grant us a limited, non-exclusive license to host, display, and reproduce that content as reasonably necessary to operate the relevant service.
This operational license does not authorize us to use private client work, your name, image, or testimonial in public marketing without separate permission.
These Terms do not prohibit honest reviews or lawful criticism.
14. Privacy and Communications
Our separate Privacy Policy explains how we collect, use, retain, and disclose personal information.
We may send service-related communications concerning purchases, account access, billing, scheduling, and changes affecting an Offering.
Marketing communications are handled separately, with consent and opt-out mechanisms where required.
Providing a phone number or accepting these Terms does not, by itself, authorize automated promotional text messages. Any marketing-text program will use a separate opt-in process and applicable program disclosures.
15. Suspension and Termination
We may suspend or terminate access for a material violation of these Terms, including unauthorized distribution, fraudulent activity, serious harassment, security abuse, or failure to make agreed payments.
When reasonably appropriate, we will provide notice and an opportunity to resolve the issue. Immediate suspension may be necessary for fraud, threats, security risks, or serious intellectual-property violations.
Any termination, refund determination, or remaining payment obligation will be handled consistently with the applicable agreement and law.
If we terminate an Offering for reasons unrelated to your breach, we will honor existing delivery commitments or provide an appropriate remedy.
16. Warranties and Limitation of Liability
Except for express commitments made in the applicable purchase terms, and to the extent permitted by law, our website and Offerings are provided “as is” and “as available.”
We do not warrant that every Offering will satisfy every individual preference or produce a particular business outcome.
To the fullest extent permitted by law:
CDM Creative LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from an Offering.
Our total liability for claims relating to a paid Offering will not exceed the amount you paid for that Offering.
These limitations do not apply to fraud, willful misconduct, gross negligence, or any liability that cannot lawfully be excluded or limited.
Nothing in these Terms eliminates an express obligation to deliver purchased services or a refund required by law.
17. Third-Party Claims
To the extent permitted by law, you agree to indemnify CDM Creative LLC against third-party claims, damages, and reasonable legal expenses arising from:
Content you provide that infringes another party’s rights.
Your unlawful use or unauthorized redistribution of our materials.
Your material violation of these Terms.
This obligation does not apply to the extent a claim results from our own misconduct or breach.
We will provide prompt notice of a covered claim and reasonably cooperate in its defense. No settlement may impose an admission, financial obligation, or nonmonetary obligation on a party without that party’s consent.
18. Events Beyond Our Reasonable Control
We are not responsible for delays caused by events beyond our reasonable control, such as natural disasters, government restrictions, major utility failures, or widespread third-party platform outages.
We will make reasonable efforts to communicate disruptions and resume performance.
If an event materially prevents delivery for an extended period, we will work toward rescheduling, an alternative, or an appropriate refund for undelivered services, consistent with applicable law.
19. Disputes and Governing Law
Please contact info@cdm-creative.com with a description of any concern so we can attempt to resolve it informally.
Informal discussions do not prevent either party from exercising legal rights or meeting a filing deadline.
These Terms are governed by Texas law, without regard to conflict-of-law rules, except where mandatory law provides otherwise.
Subject to applicable consumer protections and jurisdictional requirements, disputes may be brought in courts of competent jurisdiction in Texas.
These Terms do not require binding arbitration or waive class-action or jury-trial rights.
20. Changes to These Terms
We may revise these Terms and will update the “Last Updated” date.
Revised Terms apply to future purchases after their effective date.
For existing purchases, we will not retroactively reduce promised access, change an agreed price, or remove an expressly promised benefit without your agreement or another lawful basis.
If a material change affects an ongoing service, we will provide notice and obtain acceptance where required.
21. General Provisions
21.1 Entire Agreement
These Terms, together with applicable purchase terms and any signed service agreement, constitute the agreement concerning the relevant Offering.
Our Privacy Policy separately governs the handling of personal information.
21.2 Severability
If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
21.3 No Waiver
Our failure to enforce a provision on one occasion does not waive our right to enforce it later.
21.4 Assignment
You may not transfer account access or your license without our written permission, except where applicable law permits otherwise.
We may transfer this agreement as part of a business sale, merger, or reorganization, provided that the transfer does not reduce your existing contractual rights.
21.5 Electronic Acceptance
Where permitted by law, your affirmative electronic acceptance may form a binding agreement. We may retain records of your acceptance and the Terms presented at that time.
